How to Evict a Tenant from Hell – Cape Coral Property Management Education

Hopefully you won’t ever get a tenant from hell, but if you do get someone who doesn’t pay the rent or doesn’t follow the lease, you’re going to have to know how to evict that tenant.

Start Immediately

First, don’t waste time. If the tenants are giving you a problem, serve them a Three Day Notice immediately. That starts the eviction ball rolling. You’ll follow up with a Five Day Notice and a Seven Day Notice. Be careful with these. You have to have them filled out correctly and every single detail has to be perfect. For example, if you don’t list all the occupants that are on your lease, you need to start the whole process over again.

Court Deadlines

Once you have served the necessary notices, you have to file court papers in a timely manner. If you miss a deadline, you will need to start over. Most of the time, tenants don’t respond to your notices and filings. If they do, you face a whole different ballgame. Just make sure you get all of your paperwork done on time and correctly.

Tenant Communication

In the past, if we’ve had to deal with a problem tenant, we simply knock on the door, acknowledge the problem and try to negotiate. We tell the tenants that we don’t want to evict and we can see that they clearly don’t want to stay in the property. In some cases, you can get them to leave without an eviction. That saves you time and money and it also helps them. Eviction will show up on their record and they’ll have a hard time renting another place. Try to negotiate and get them out.
